The special magistrate who presided over my hearings in Collier County last week stated he is an attorney AND an appraiser. I remember that he even said MAI.
 
I can find a listing on line in the Florida Bar for one lawyer with the same name. However, I can find no one with that name licensed as an appraiser in the on line search feature of the Florida Department of Professional Regulation, nor in The Appraisal Institute's list of members.
 
As you already are aware, the special magistrate asked a question of me during the proceedings that invoked the "pick a number scheme" that was debated and deliberately deleted from use with the adoption of The Presumption Bill. The abuse continues throughout the state, even though DOR has received copies of local rules - arguably unlawfully adopted - the content of which is full of end runs around 194.301. DOR has NOT it seems informed any of the counties of their non-compliance.
 
In addition, since the adoption of The Presumption Bill, among the other statutory changes there is a provision that special magistrates who hear value cases must be licensed and experienced appraisers. I am not suggesting the special magistrate in Collier County misrepresented his credentials. I do not have access to his application to work in Collier County, which should be checked, as an appraiser special magistrate. And, I have no expeditious way to ask for a copy of his license.  I am, however, surprised, to NOT find verification of his appraisal license in the state system's on line data base.  
 
How does a petitioner get a lawful VAB hearing in the State of Florida? DOR does nothing to ensure compliance.
